The Short Version

By using PhotoCuller or our website, you agree to these terms. PhotoCuller for Mac is available through a direct one-time license. PhotoCuller for iOS offers a feature-limited version, auto-renewing subscriptions, and a one-time lifetime purchase through Apple's App Store. Different billing and refund rules apply to direct and App Store purchases as described below.

Using PhotoCuller

• A direct PhotoCuller license may be activated on up to 2 Macs for your own use, unless your order states otherwise.
• PhotoCuller for iOS may be used on devices associated with the Apple ID that obtained it, subject to Apple's App Store and Family Sharing rules.
• An eligible desktop license may also unlock the iOS app when that license includes mobile access and remains valid. Device activation limits may apply.
• You may not copy, resell, sublicense, reverse engineer, or redistribute the app except where applicable law expressly permits it.
• You may use PhotoCuller only for lawful purposes and are responsible for keeping your devices, license keys, source media, destinations, and backups secure.

Email Communications

By providing your email address (for example, when requesting a Mac download link), you agree to receive occasional emails from K-Squared Labs related to PhotoCuller. These may include product update announcements and infrequent promotional offers such as discounts.

Every email includes an unsubscribe link. You can opt out at any time.

Purchases and Billing

Direct Mac Purchases

Direct Mac payments are processed securely through our checkout provider. Taxes, payment methods, and billing details are handled during checkout. A direct purchase is a one-time license purchase, subject to the version and update coverage shown at checkout.

Authorized Reseller Purchases

An authorized reseller may sell a single-use PhotoCuller redemption code through its own storefront. The reseller independently controls its price, payment methods, taxes, receipts, and sales terms. A valid code grants only the product identified by the code and has no cash value. Codes may not be copied, resold again, or used more than once.

iOS App Store Purchases

Apple processes all iOS payments. PhotoCuller may offer monthly and annual auto-renewing subscriptions and a one-time lifetime in-app purchase. Products, prices, currencies, subscription periods, trial availability, and eligibility are displayed in the app before you confirm a purchase. The terms shown in Apple's purchase sheet control if they differ from a general description on this website.

Customer Referral Program

• A valid referral gives the purchaser 10% off each qualifying new Desktop or Bundle license purchase. Referral discounts do not apply to renewals, upgrades, device expansions, or App Store purchases and cannot be combined with another monetary discount.
• An eligible referring license earns a one-year coverage extension for every three qualifying referred purchases. Rewards may be earned repeatedly and have no program cap.
• Purchases qualify after the 30-day refund period. Refunded, reversed, test, or self-referred transactions do not qualify.
• Referral rewards have no cash value and cannot be transferred to another license. We may reject or revoke rewards obtained through fraud, manipulation, or program abuse.
• We may change or end the referral program prospectively. Purchases already recorded as pending when the program ends will retain their opportunity to qualify under the terms in effect when purchased.

Auto-Renewing Subscriptions

• Payment is charged to your Apple Account when you confirm the purchase.
• A subscription automatically renews for the same period unless you cancel it at least 24 hours before the end of the current period.
• Apple charges your account for renewal within 24 hours before the current period ends.
• You can manage or cancel your subscription in your Apple Account or App Store subscription settings. Deleting PhotoCuller does not cancel a subscription.
• If an introductory free trial is offered and you are eligible, it converts to the displayed paid subscription unless canceled at least 24 hours before the trial ends.
• Access continues through the end of a paid billing period after cancellation unless Apple states otherwise.

The lifetime product is a non-consumable in-app purchase that unlocks the iOS full version for the purchasing Apple ID. Use Restore Purchases in the app to ask Apple to restore an eligible purchase on another device.

Refunds

Direct Mac Purchases

• We offer a 30-day money-back guarantee from the original direct purchase date.
• To request a direct-purchase refund, email [email protected] and include your order email or receipt.
• Approved refunds are returned to the original payment method. After 30 days, direct purchases are non-refundable except where required by applicable law.

Authorized Reseller Purchases

Refunds for purchases made from an authorized reseller must be requested from that reseller under its refund policy. K-Squared Labs cannot refund a payment it did not process. A refunded or reversed reseller purchase may result in revocation of its redemption code or associated license where permitted by law.

App Store Purchases

Apple controls billing and refunds for subscriptions and lifetime purchases made through the App Store. Our direct 30-day guarantee does not apply to App Store purchases. You may request a refund from Apple at reportaproblem.apple.com, subject to Apple's policies and applicable law.

Apple Services and Terms

If you obtain PhotoCuller through the App Store, your use of the app is also subject to Apple's Standard Licensed Application End User License Agreement and Apple Media Services Terms and Conditions. Those terms apply to App Store licensing, billing, Family Sharing, and Apple's services. Apple, not K-Squared Labs, operates the App Store, StoreKit, iCloud, CloudKit, and Apple Photos services.

iCloud Sync depends on your Apple ID, available iCloud storage, network access, and Apple's service availability. You can control individual PhotoCuller sync categories in the app's Settings. We do not guarantee that third-party services will always be available or error-free.

Your Photos, Metadata, and Outputs

You retain ownership of your photos, metadata, templates, and other content. You grant PhotoCuller only the permission needed to access and process content you select so the app can perform the actions you request. You are responsible for having the rights to use that content and for reviewing metadata, rename, delete, transfer, export, and workflow results. Keep independent backups of important files; PhotoCuller is not a backup service.

License Validation and Service Availability

Direct licenses and desktop-license access on iOS may require online activation or periodic validation. Offline access may be available for a limited period after successful validation. We may suspend or revoke access associated with an invalid, refunded, expired, shared, fraudulent, or abused license or transaction. Features and system requirements may change as we maintain the app, address security issues, or adapt to Apple platform changes.

Privacy

Our Privacy Policy explains how PhotoCuller processes app, purchase, license, iCloud, and website data and is incorporated into these terms.

Intellectual Property

PhotoCuller, including its code, design, branding, and documentation, is owned by K-Squared Labs and protected by intellectual property laws. Third-party and open-source components remain subject to their respective license terms, which are available in the app where required.

Warranty Disclaimer

PhotoCuller is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, K-Squared Labs is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business.

Changes to These Terms

We may update these terms from time to time. Updated terms will be posted on this page with a revised "Last updated" date.
